We have made it clear for some time now that the most straightforward way to secure a licence for charter in the Balearics is by having an EU-owned, flagged and operated vessel – for instance in Malta which is a full EU member and has double taxation treaties with more than 67 countries. The whole of Europe, not just Spain, is clamping down on perceived ‘tax havens’ and it can become problematic for these non-EU yachts.

However, Network Marine Consultants has recently put together a simple formula which would resolve this issue: in brief, establishing a link with an EU Company which would then operate the yacht throughout Europe via a time charter agreement. Every case is different so, along with highly reputable independent tax advisors, we create a simple tailor-made structure to suit.
