The Spanish Central Government has now issued new legislation relating to the gradual lifting of the general lockdown limitations.
Basically, it consists of 4 phases; 0 – 3 and is principally aimed at defining movement of individuals. However, thanks to ANEN (National Association of Nautical Businesses) the Spanish Central Government has now clarified that yachting, irrespective of being private or charter, is not considered as part of the Maritime/Shipping Sector and thereby is not controlled by the legislation controlling that sector. This means that in general, movement of yachts is linked to the legislation relating to movement of individuals and the opening of Ports and Airports.
Note that as Autonomous Regions, the Balearic Islands and Canary Islands, have additional legislation in place and, any lifting of lockdown laws by the Central Madrid Government needs to be passed by each Autonomous Government, e.g. opening of Ports, Marinas and Airports.
A brief summary: –
Phase 0 (applicable from 4th May 2020): No yachting activity. Under exceptional circumstances sporting activity is allowed but only by individuals and only in the municipality where that person is resident.
Owners may visit their yachts to check on safety and maintenance but only if the yacht is in the same municipality where the owner resides. Only one person allowed on board, always complying with the Health and Safety protocol established by each Port/Marina.
Phase 1 (11th May 2020): Pleasure Yachting permitted as Tourism or Cultural activity in restricted groups on board, area limited to either Municipality or Province/Island where owner or guests are resident. (Pending clarification from Central Government)Health and Safety rules must always be followed. (Note that this activity is dependent on separate legislation controlling the opening of Ports and Marinas)
Phase 2: Pleasure Yachting permitted as Tourism or Cultural activity, larger groups allowed on board; area limited to Province or Island where owner or guests are resident. Health and hygiene rules must always be followed. . (Note that this activity is dependent on opening of Ports and Marinas)
Practical Training also permitted.
Phase 3 (Mid June): Pleasure Yachting permitted as normal with no exceptional limitations except for those that apply under normal circumstances such as geographical limits or health and safety requirements.
